Write Sprites — Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Two Cardinals Media LLC (“Two Cardinals Media,” “we,” “us,” or “our”), which owns and operates Write Sprites (the “Service”). By creating an account or otherwise using Write Sprites, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be 18 years of age or older to create an account or use Write Sprites. By creating an account, you represent and warrant that you are at least 18 years old. We do not knowingly permit anyone under 18 to use the Service, and we may terminate any account we discover belongs to someone under 18, without notice.

The Service is operated from the United States and is available only to users who reside in the United States. By creating an account, you represent and warrant that you reside in the United States. We do not offer the Service to individuals located in the European Economic Area, the United Kingdom, or Switzerland, and we may suspend or terminate any account we learn belongs to a user who does not reside in the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for complying with your local laws.

2. Description of the Service

Write Sprites is a writing-productivity application that tracks your writing sessions and rewards consistent writing with progress in a virtual pet/companion game (levels, experience points, streaks, cosmetic items, challenges, and related features). Write Sprites is a tool to encourage and gamify your own writing habit. It does not publish, distribute, or share your writing with anyone else unless you choose to do so yourself.

We may add, change, or remove features of the Service at any time, and we may discontinue the Service entirely (see Section 15).

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Tell us promptly if you believe your account has been compromised.
You agree to provide accurate information when creating your account and to keep it up to date.
You may delete your account at any time from Settings. Deleting your account removes your access to the Service and, as described in Section 6 of our Privacy Policy, your associated data.
We may suspend or terminate your account for violating these Terms, for fraudulent or abusive behavior (including abuse of the Service’s game mechanics, such as artificially inflating word counts through automated tools or bulk-pasting text not written by you), or if we reasonably determine that your use of the Service creates risk or harm for us or other users. If we terminate a paid account for reasons other than your violation of these Terms, we will refund the unused portion of your current subscription period.
We may correct, adjust, or reverse word counts, streaks, rewards, or items that resulted from bugs, errors, or manipulation of the Service.

4. Subscriptions and Payments

Write Sprites offers a free tier and an optional paid subscription tier (“Pro”), as well as optional one-time purchases of in-app items, billed through our payment processor, Stripe. Current pricing and what each tier includes are shown at checkout.
Automatic renewal. Pro subscriptions renew automatically at the end of each billing period (monthly or annually, depending on the plan you choose) at the then-current price until you cancel. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis.
Cancellation. You can cancel anytime from Settings. Cancellation takes effect at the end of your current billing period, and you will retain Pro access until then. You will not be charged again after you cancel.
Failed payments. If a renewal payment fails, we may retry the charge, and your account may revert to the free tier until payment succeeds.
Taxes. Prices may be subject to sales or other taxes where required by law, which will be shown at checkout.
Refunds. All sales are final. Payments and subscription charges are generally non-refundable, except where required by applicable law, as stated in Section 3, or at our discretion on a case-by-case basis. If you believe you were charged in error, contact us at the address in Section 17.
Price changes. We may change subscription pricing going forward and will provide reasonable notice before any increase takes effect for existing subscribers. You may cancel before the increase applies.
When Pro ends. If your Pro subscription ends or lapses, you lose access to Pro-only features. Levels, experience, streaks, and items you earned or received while subscribed remain in your account. Pro includes unlimited version history for your documents. When Pro ends, free-tier limits apply: your version history is limited to the last 30 days, and version history older than 30 days is permanently deleted 30 days after your subscription ends. You can resubscribe during that 30-day period to keep your full version history.

5. Virtual Items

Levels, experience points, streaks, cosmetic items, props, backgrounds, sprites, and any other virtual items or currency within Write Sprites (“Virtual Items”), whether earned, granted, or purchased, are licensed to you for use within the Service only. Virtual Items:

Have no cash value and cannot be redeemed, exchanged, transferred, sold, or gifted for real money or anything of value, whether inside or outside the Service.
Remain our property at all times. You receive a limited, revocable license to use them within your account, not ownership.
May be modified, and their availability may change, at our discretion. Rewards, drop rates, and eligibility requirements for challenges and other features may change over time.
Are forfeited without compensation if your account is deleted or terminated for violating these Terms.

6. Your Content

You retain full ownership of the writing, text, and other content you create and store using Write Sprites (“Your Content”). We do not claim any ownership over it, and we will not use it for any purpose other than operating, maintaining, and improving the Service for you, for example storing it so you can access it and measuring word counts to power the game mechanics described in Section 2. We do not use Your Content to train AI or machine learning models.

By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content back to you as necessary to provide the Service. This license ends when you delete the relevant content or your account, except where retained briefly for backups or as described in our Privacy Policy.

Your writing is private by default. We do not access it except as described in Section 3 of our Privacy Policy.

You are responsible for Your Content and confirm that you have the right to create and store it, and that it does not violate any law or any other person’s rights.

7. Acceptable Use

You agree not to:

Use the Service for any illegal purpose, or to store or generate content that is unlawful, infringing, or that facilitates harm to others.
Use a display name, sprite name, or other account detail that is hateful, harassing, threatening, sexually explicit, defamatory, deceptive, or that impersonates another person or violates their rights or privacy.
Attempt to gain unauthorized access to other users’ accounts or to any part of the Service’s systems.
Use bots, scripts, macros, or other automated means to interact with the Service, artificially generate word counts, or otherwise manipulate the game mechanics described in Section 2, including bulk-pasting text not written by you.
Create multiple or fraudulent accounts to gain rewards or evade enforcement.
Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where applicable law expressly permits it.
Resell, sublicense, or commercially exploit access to the Service without our written permission.

8. Intellectual Property

Aside from Your Content, the Service, including its software, design, virtual pet artwork, branding, and all associated intellectual property, is owned by Two Cardinals Media LLC or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

9. Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice to our designated agent at the address below that includes: (a) identification of the copyrighted work; (b) identification and location of the material you claim is infringing; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf; and (f) your physical or electronic signature.

We may remove material that appears to infringe and may terminate the accounts of repeat infringers.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA LOSS WILL NOT OCCUR. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUP COPIES OF ANY WRITING THAT MATTERS TO YOU.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TWO CARDINALS MEDIA LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $50, WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR DELAYS OR FAILURES CAUSED BY EVENTS BEYOND OUR REASONABLE CONTROL.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Two Cardinals Media LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, Your Content, or your misuse of the Service.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or an in-app notice) before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Assignment and Discontinuation

We may assign or transfer these Terms, and our rights and obligations under them, to an affiliate or to a successor in connection with a merger, acquisition, reorganization, or sale of assets, including transferring Write Sprites to a separate legal entity. We will notify you of any such transfer. You may not assign these Terms without our written consent.

We may discontinue the Service at any time. If we discontinue the whole Service, we will give reasonable notice where practical so you can copy your writing, and we will refund the unused portion of any prepaid subscription period.

16. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. A waiver is effective only if in writing. Sections that by their nature should survive termination (including Sections 5, 6, 8, and 10 through 13) will survive.
